Privacy and cookie statement

1. Who we are

Makelaar in Amsterdam B.V. is responsible for processing personal data as described in this statement.

2. What data we process

Depending on how you get in touch with us, we process some of the following data:

• Name, address, phone number and email address
• Date and place of birth, when needed for a purchase or rental agreement
• Details from your identity document, for the legally required identification (see below)
• Details of the home for which you engage us
• Financial details needed for the assignment, such as your bank account number or the financing of a purchase
• Messages you send us by email, WhatsApp, phone or a form on the website

As estate agents we fall under the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act (Wwft). This means we have to identify our clients and keep a copy of their identity document. This is a legal obligation.

We do not process special categories of personal data, such as data about your health, religion or ethnic background. We only process a citizen service number (BSN) when the law requires it.

3. Why we process this data

We only use your data for a clear purpose, and always on one of the legal grounds set out in the General Data Protection Regulation (GDPR):

• To carry out our assignment: guiding the sale, purchase or letting of your home, scheduling appointments and viewings, and keeping in touch with you. Legal ground: our agreement with you.
• To respond to your request for a market valuation, an introduction or information. Legal ground: your request, as preparation for a possible agreement.
• To meet our legal obligations, such as the identification under the Wwft and our tax returns. Legal ground: legal obligation.
• To send you a newsletter or other promotional message. Legal ground: your consent, which you can withdraw at any time. If you viewed a home with us, we sometimes email you about a new home that matches what you viewed. Legal ground: our legitimate interest in showing you relevant homes. Don't want this? Reply to that email with 'unsubscribe'.

We do not make decisions about you that are taken by a computer alone (automated decision-making). One of us is always involved.

4. How long and how securely we keep data

We do not keep your data longer than necessary. Data from an assignment is kept as long as the law requires: 7 years for our financial records (the tax retention obligation) and 5 years after the end of the assignment for the data from the Wwft identification. Data from a request that does not lead to an assignment is in principle kept for no longer than 2 years.

We keep all client data safe. We take appropriate technical and organisational measures to protect it against loss, misuse and unauthorised access. Your data is stored in secure systems that only our own team can access, the connection to our website is encrypted, and within the team only the people working on your file can see your data.

5. Sharing with third parties

We never sell your data. We only share it when this is necessary for your assignment or when the law requires it, for example with the civil-law notary, an appraiser, the estate agent of the other party or funda. Other parties only receive your data with your explicit consent.

For our work we use software from other companies, for example for our client system, email, document storage and our accounting. We sign a data processing agreement with these companies, so they handle your data as carefully as we do and only use it on our behalf.

Some of these suppliers, such as Google, are based outside the European Union or use servers outside it. We only work with parties that protect your data just as well there, for example through the EU-US Data Privacy Framework or the standard contractual clauses of the European Commission.

6. Cookies

This website uses functional cookies. These are needed for the site to work properly, for example to remember your language choice and to send forms securely.

We also use Google Analytics to see how visitors use the website, for example which pages are viewed most. This helps us improve the site. Google Analytics does not store full IP addresses, and we do not use this data to track you personally.

On some pages we show content from other parties, such as videos from YouTube, maps from Google Maps and the viewing planner from Housap. These parties may receive your IP address and place their own cookies. Their own privacy statements apply to this.

Google Analytics only sets cookies once you accept them in the cookie notice. If you decline, we only count your visit anonymously, without cookies. You can change your choice at any time via "Cookie settings" at the bottom of every page. You can also delete cookies through your browser settings.

7. Your rights

You have the right to access your data, have it corrected or have it deleted. You can also withdraw your consent, object to the processing and ask us to send your data in a computer file to you or to another organisation. Data we are legally required to keep, for example for the Wwft or the Dutch Tax Administration, can only be deleted once that retention period has ended.

Send your request to info@makelaarinamsterdam.nl. To make sure the request really comes from you, we may ask you to include a copy of your identity document. On that copy, black out your passport photo, the strip of numbers and letters at the bottom (MRZ), your document number and your BSN. We respond as quickly as possible, and within four weeks at the latest.

Do you disagree with how we handle your data? Then you can file a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens.

8. Changes

We may change this privacy statement, for example when our services or the law change. The date at the top of this page shows when the statement was last updated.
